Pocket Bot Terms and Conditions

1. Introduction Welcome to Pocket Bot. These Terms and Conditions (“Terms”) govern your use of our platform, which offers business directory services, private shopping via Telegram bots, social media advertising, and various digital solutions. By using Pocket Bot, you agree to these Terms. If you do not agree, please do not use our platform.

2. Definitions

• “Platform” refers to Pocket Bot, including the website, Telegram bots, and associated services.
• “User” refers to any individual or business accessing or using our services.
• “Vendor” refers to businesses or individuals offering products/services via Pocket Bot.
• “Customer” refers to users purchasing or inquiring about products/services.
• “Subscription” refers to any paid service or upgrade available through Pocket Bot.
• “Freelancer” refers to an individual advertising their services on Pocket Bot.
• “We,” “us,” or “our” refers to Pocket Bot.

3. Eligibility You must be at least 18 years old to use Pocket Bot. By accessing our services, you confirm that you meet this requirement.

4. Services Provided Pocket Bot offers:

• A business directory for vendors to showcase their services/products.
• Private shopping via Telegram bots, enabling transactions and inquiries.
• Secure payment processing through multiple methods, including IBAN, crypto, and other third-party payment providers.
• Lead generation opportunities for vendors based on customer inquiries.
• A premium subscription service that offers enhanced features for a monthly fee.
• Social media promotion, including account growth services and paid advertising options.
• Freelancer listings, allowing individuals to advertise their services to potential clients.
• Escrow services for secure crypto transactions with multiple service tiers.

5. Pocket Bot Subscription Service

• The Pocket Bot Subscription is a recurring paid service offering exclusive features and benefits.
• The subscription is billed monthly at $9.99 unless otherwise stated.
• Subscriptions are automatically renewed unless canceled at least 24 hours before the renewal date.
• Payments are processed via third-party providers, and users are responsible for maintaining valid payment information.

6. Managing Your Subscription & Refund Policy

• Users can subscribe through the Pocket Bot platform and manage their subscription settings within their account.
• Canceling a subscription will prevent future charges, but access to premium features will remain active until the end of the current billing cycle.
• Refunds are not provided for partial subscription periods unless required by law.
• Chargebacks initiated against valid transactions may result in account suspension.

7. Vendor Responsibilities

• Vendors must ensure their listings are accurate, lawful, and not misleading.
• Vendors are responsible for fulfilling orders and handling disputes with customers.
• Vendors must comply with all applicable laws regarding their business operations and products/services.
• Pocket Bot reserves the right to remove any listings that violate these Terms.

8. Freelancer Listings

• Freelancers advertising their skills must ensure all information is truthful and accurate.
• Pocket Bot may require proof of an active freelance account on a major platform as a condition of listing.
• Pocket Bot is not responsible for any freelancer’s services, quality, or conduct.

9. Business Directory Listings

• Businesses can claim listings or create new listings via different payment methods.
• Reviews left by users do not necessarily reflect the opinions of Pocket Bot.
• Pocket Bot does not verify the authenticity of reviews but allows a reporting mechanism for false or misleading content.

10. User Reviews & Liability

• Reviews are submitted by users and do not represent Pocket Bot’s opinions.
• We are not responsible for verifying the accuracy or authenticity of reviews.
• Vendors and businesses may report fake or defamatory reviews for investigation.
• Pocket Bot is not liable for reputational damage resulting from user-generated content.

11. Bot Renters & Content Responsibility

• Users who rent bots are responsible for all content they offer for sale.
• Pocket Bot does not control or endorse the content offered within Telegram bots.
• A reporting function is available to flag illegal or inappropriate use of bots.

12. Escrow & Crypto Transactions

• Crypto transactions are one-way and non-reversible.
• Escrow services are available for Bronze and Silver tiers, ensuring funds are held until terms are met.
• Gold and Platinum tiers require AML (Anti-Money Laundering) and KYC (Know Your Customer) verification for identity confirmation.
• Pocket Bot is not liable for any losses due to disputes outside the escrow system.

13. Acceptable Use Policy (AUP) Users must not:

• Use the platform for illegal, fraudulent, or deceptive purposes.
• Post false, misleading, or offensive content.
• Attempt to circumvent platform fees or engage in unauthorized transactions.
• Violate any applicable laws, regulations, or third-party rights.
• Engage in harassment, spamming, or abusive behavior toward other users.
• Exploit security vulnerabilities or attempt unauthorized access to platform data.

14. Payment Disputes & Chargebacks

• Unauthorized chargebacks may result in account suspension or permanent banning.
• Users disputing payments must contact Pocket Bot before filing a chargeback.
• Vendors and freelancers are responsible for handling their own payment disputes with customers.

15. Telegram API & Third-Party Services Disclaimer

• Pocket Bot integrates with Telegram’s API but is not affiliated with, endorsed by, or responsible for Telegram’s services.
• Users must comply with Telegram’s Terms of Service when using Telegram-based features.
• Pocket Bot is not responsible for any service outages, policy changes, or account restrictions imposed by Telegram.
• Vendors and bot renters acknowledge that Pocket Bot only provides software and does not control Telegram’s infrastructure or policies.

16. Governing Law & Jurisdiction

• These Terms and Conditions are governed by and construed under the laws of Iceland and Panama.
• Any disputes or legal matters arising under these Terms shall be resolved exclusively in the courts of Iceland or Panama.
• Users agree that any legal actions must be brought within these jurisdictions and not under the laws of any other country.
• If any part of these Terms is deemed unenforceable, the remaining provisions shall remain in full effect.

17. Limitation of Liability & Disclaimer

• Pocket Bot provides a platform but does not endorse, verify, or guarantee any listings, services, or freelancers.
• We are not liable for disputes, fraud, or poor service from vendors, freelancers, or bot renters.
• Users assume full responsibility for verifying the legitimacy of vendors and service providers.
• We do not guarantee uninterrupted service and are not liable for any losses resulting from downtime or system errors.
• Users agree to indemnify and hold Pocket Bot harmless from any claims, losses, or damages arising from violations of these Terms.

18. Dispute Resolution

• Any disputes between users should be resolved amicably.
• If mediation is required, Pocket Bot may assist but is not obligated to provide legal support.
• Legal disputes will be governed by the laws of Iceland and Panama, and disputes shall be settled in the courts of those jurisdictions.

19. Changes to These Terms We may update these Terms from time to time. Continued use of the platform after changes indicates acceptance.

20. Severability Clause If any provision in these Terms is found to be invalid or unenforceable, the remaining Terms shall remain in full effect.

21. Entire Agreement These Terms constitute the entire agreement between users and Pocket Bot, superseding any prior agreements.

22. Waiver Failure to enforce any provision of these Terms shall not be considered a waiver of our rights.
